Makruh does not mean freely allowed; it means disliked and discouraged, and a believer is encouraged to avoid it. Mouthwash or toothpaste while fasting does not break the fast if nothing reaches the throat, but is regarded as makruh because of the strong taste and risk of something reaching the throat and invalidating the fast.
